LICENCE
Subject to these Terms of Use, the European Rental Association (“ERA”) hereby grants you a limited, non-exclusive, non-transferable, non-sublicenseable licence to use the ERA Total Cost of Ownership Calculator (“TCO Calculator”) and ERA Equipment CO2 Calculator ("CO2 Calculator") solely for educational and personal informational use. You acknowledge that ERA is not obligated to provide support services, maintenance, updates or upgrades for and in connection with the Calculators.
USE RESTRICTIONS AND OWNERSHIP RIGHTS
ERA owns and retains all right, title, and interest, including all intellectual property rights to the Calculators, including any modifications and improvements. You will not, and will not encourage any third party, to modify, reverse-engineer, distribute or commercialise the Calculators. All data generated by using the Calculators will be owned and stored by you. ERA does not store such data, and will have no access to such data. ERA reserves the right to withdraw or amend the Calculators in its sole discretion without notice. You agree not to access or use the Calculators by any automated means for any purpose including the monitoring or copying of the Calculators or their functionality. You may link to the Calculators from other websites provided that you do so in a way that is fair and legal and does not damage our reputation or misrepresent a link, association, approval or endorsement on the part of ERA without ERA’s express written consent.
DISCLAIMER
The TCO Calculator was developed at ERA’s request by Solvay Brussels School of Economics & Management. The Calculator is intended to provide an example of the total cost of ownership.
The CO2 Calculator’s methodology, calculation framework and environmental background data were developed by CE Delft at the request of ERA. The CO2 Calculator is a tool to estimate the carbon footprint of construction equipment over a defined period of time and/or its entire lifecycle.
For both the TCO Calculator and CO2 Calculator, the calculations are based on your input and are provided “as is”.
All figures are hypothetical and may not be accurate indicators of historical or current performance. These Calculators and the results they provide do not take into account individual circumstances and should not be relied upon as the sole source of information. ERA expressly disclaims all implied warranties or representations regarding the fitness for use, validity, non-infringement or accuracy of the results obtained by using the Calculators, and no communication or information about the Calculators obtained on or through this site or directly from ERA shall create any warranty. ERA will not be liable for technical errors contained in the Calculators. In no event will ERA be liable for any direct, indirect, incidental, special or consequential damages, or damages for loss of profits, revenue, data or data use, incurred by you or any third party, whether in an action, in contract or tort, arising from your access to, or use of, this site or any content provided on or through the site. To the extent any of the above disclaimers or exclusion of certain warranties or liabilities are held to be legally invalid in any jurisdiction, all other terms of these Terms of Use shall remain in full force and effect.
CONSENT TO USE OF REGISTRATION DATA
You hereby consent to ERA retaining the information you submitted by means of the Registration Form. The information you submit will be treated in accordance with the ERA Privacy Policy, available at
http://erarental.org/en/privacy-policy, which is incorporated by reference, and will be used for the purposes described therein as well as to evaluate the total number of users and the types of company they work at.
APPLICABLE LAW AND DISPUTE RESOLUTION
All disputes arising from the interpretation and application of these Terms of Use shall be subject to Belgian law and shall be submitted to the competent courts of Belgium.
